Acceptance of Terms

By accessing and using the services provided by artifiixak B.V. ("we", "our", "us", or "artifiixak"), including our fitness facility, personal training services, and website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

These Terms constitute a legally binding agreement between you and artifiixak B.V., a company registered in the Netherlands with registration number 73196284.

artifiixak provides fitness and strength training services including:

• Access to gym facilities and equipment
• Personal training services
• Group training classes
• Fitness consultations and assessments
• Nutritional guidance
• Online resources and information

Membership and Registration

Eligibility

You must be at least 16 years old to use our services independently. Members under 18 require parental consent. You must provide accurate and complete information during registration.

Health Requirements

You must disclose any medical conditions, injuries, or health concerns that may affect your ability to exercise safely. You may be required to provide medical clearance before participating in certain activities.

Membership Fees

Membership fees are due in advance and are non-refundable except as required by law. We reserve the right to change membership fees with 30 days' notice.

User Responsibilities

As a member or user of artifiixak services, you agree to:

• Use equipment safely and as intended
• Follow all facility rules and staff instructions
• Respect other members and staff
• Maintain personal hygiene standards
• Report any injuries or equipment problems immediately
• Not share your membership with others
• Keep your contact information current
• Pay all fees on time

Prohibited Activities

The following activities are strictly prohibited on artifiixak premises:

• Use of illegal substances
• Harassment or intimidation of any kind
• Theft or damage to property
• Recording or photographing others without consent
• Selling or soliciting products or services
• Bringing weapons or dangerous items
• Disruptive or unsafe behaviour

Intellectual Property

All content, materials, and intellectual property associated with artifiixak, including but not limited to logos, trademarks, training programs, written materials, and proprietary methods, are owned by artifiixak B.V. or our licensors.

You may not:

• Copy, distribute, or reproduce our proprietary materials
• Use our trademarks or branding without permission
• Record or share our training methods commercially
• Reverse engineer our programs or systems

Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

Health and Safety

Exercise involves inherent risks. You participate in all activities at your own risk and acknowledge that artifiixak cannot guarantee your safety or prevent all injuries.

Medical Clearance

We strongly recommend consulting with a healthcare provider before beginning any exercise program, especially if you have pre-existing health conditions.

Emergency Procedures

In case of medical emergency, artifiixak staff may provide first aid and contact emergency services. By using our services, you consent to such emergency care.

Limitation of Liability

To the maximum extent permitted by law, artifiixak B.V., its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of our services, including but not limited to:

• Personal injury or death
• Property damage or theft
• Loss of income or profits
• Emotional distress
• Equipment malfunction

Our total liability to you for any claim shall not exceed the amount you paid for services in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless artifiixak B.V., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of our services, violation of these Terms, or infringement of any third-party rights.

Termination

Either party may terminate the membership or service agreement with appropriate notice as specified in your membership agreement. artifiixak reserves the right to immediately terminate or suspend your access for:

• Violation of these Terms
• Non-payment of fees
• Unsafe or disruptive behaviour
• Providing false information
• Any activity that could harm our business or other members

Upon termination, your right to use our services ceases immediately, and you must return any property belonging to artifiixak.

Cancellation Policy

Membership cancellations must be submitted in writing with 30 days' notice. Cancellations are effective at the end of the current billing period. No refunds will be provided for unused portions of memberships except as required by applicable consumer protection laws.

Force Majeure

artifiixak shall not be liable for any failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, government actions, pandemics, or other emergencies that prevent safe operation of our facilities.

Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

For EU residents, this does not affect your rights under applicable consumer protection laws in your country of residence.

Dispute Resolution

We encourage resolving disputes through direct communication. If you have a complaint, please contact us first at legal@artifiixak.life. If we cannot resolve the matter informally, disputes may be resolved through mediation or the appropriate courts as specified above.

Changes to Terms

We may update these Terms from time to time to reflect changes in our services or applicable law. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such changes constitutes acceptance of the new Terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable.

Entire Agreement

These Terms, together with our Privacy Policy and any specific membership agreement, constitute the entire agreement between you and artifiixak regarding your use of our services and supersede all prior agreements and understandings.
